4. Limitation of Liability
In no event shall Noraxavv, nor its directors, employees, or partners, be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Service. Our predictive models are tools for educational exploration; we do not guarantee specific outcomes in external business environments.
User agrees that the platform is provided on an "AS IS" and "AS AVAILABLE" basis. Noraxavv makes no warranties, expressed or implied, regarding the accuracy or reliability of any data outputs or third-party integrations used within our dashboards.
5. Indemnification
You agree to defend, indemnify and hold harmless Noraxavv and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; or b) a breach of these Terms.
6. Service Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions. Any legal action or proceeding related to your access to, or use of, the Service shall be instituted in a court in Dunedin.
